Moore & Van Allen (MVA) Employment & Labor Member John Zaloom was quoted in the Society for Human Resource Management (SHRM) article titled, “Distinctions Among Class, Collective and Representative Actions Make a Difference” which was published on August 23.
In a collective-action case in which the employer discovers a bona fide pay issue such as missed overtime payments, the correct course of action likely will be to notify affected employees that the employer has fixed the issue and is providing back pay with interest for the missed overtime payments at least over the past two years, said John Zaloom.
