Thanks to social media, a content-hungry public, clients' perceptions and competing interests, the age-old advice of remaining silent and stating "no comment" is rarely a cost-free or even viable strategy today.
Lawyers should be prepared to inform client decisions about both the content and timing of public statements and, as a result, better position clients and themselves to address clients' prior statements in public forums and future legal proceedings.
