Kirk Quoted in Healthcare Risk Management

Charlotte Health Care Counsel Kimberly Kirk was quoted in the August 2013 issue of Healthcare Risk Management.  The article, "Onus is on you to determine business associates under HIPAA," addresses the final HIPAA rule, which broadened the definition of business associates and goes into effect on September 23, 2013.

“Providers cannot wait for business associates to make their own determination because an incorrect conclusion leaves the healthcare provider at risk,” Kirk stated. “A party becomes a business associate by definition – their function and what they do – and not what they decide.”
