McGinnis Quoted in Law360 Article on Target's Breach Settlement
Privacy and Data Security Member Karin McGinnis was quoted in Law360 on March 19, in the article “Target’s $10M Breach Settlement Sets Affordable Standard.” The article discusses how Target Corp.'s proposed $10 million settlement of a class action over its massive 2013 data breach isn’t likely to be surpassed in the near future, given how difficult it has been for plaintiffs to show harm for which companies need to compensate consumers.
The author writes “McGinnis noted that settlement figures could also be bolstered by courts starting to accept more novel injury claims such as emotional distress and consumer protection law violations, which have yet to gain much traction in court. “But in the absence of courts accepting those claims, in the credit card space, it would be hard to see settlements much higher than this one,” she said.”
