Anup Iyer, Intellectual Property Senior Counsel at Moore & Van Allen (MVA), was featured in a recent  Managing IP article, “Why OpenAI opinion opens ‘roadmap’ for practitioners: counsel,” analyzing a significant opinion from the U.S. District Court for the Southern District of New York involving copyright and trademark claims against generative AI companies.

As courts continue to shape the legal framework surrounding AI development and IP protection, Anup offered valuable commentary on the potential risks for developers:

This decision provides further clarity on issues such as contributory infringement and the statute of limitations in the AI context, and underscores the importance of proactive legal strategies for organizations engaging with emerging technologies.
